Terms of Use

1. Purpose

These terms of use (“Terms of Use”) govern access to and use of the SimuChat service, available at https://simuchat.net (the “Service”), published by 4iNTE (the “Publisher”, see the legal notice). The purchase of credits is governed by the terms of sale (“Terms of Sale”), and the processing of personal data by the privacy policy.

Creating an account means accepting, without reservation, the Terms of Use, the Terms of Sale and the privacy policy, by ticking a box. Acceptance is time-stamped and kept.

2. Description of the Service

The Service allows the user:

• to import exports of their own conversations (iMessage/SMS, WhatsApp, Instagram, Messenger, Snapchat, TikTok, Android);
• to obtain, for each contact, a writing profile: automatically calculated statistics and, depending on the case, a profile written by an artificial intelligence;
• to chat with a simulation of the contact: the replies are generated by an artificial intelligence model based on the profile and the imported messages.

The Service is provided as is, in French, English, Spanish, Portuguese, German, Italian and Chinese, and is intended for private individuals for personal, non-commercial use. The legal documents (Terms of Use, Terms of Sale, privacy policy, legal notice) are translated to make them easier to read; in case of any difference, the French version prevails.

3. Nature of the simulations — artificial intelligence

• You are interacting with an artificial intelligence system, not with the person imitated. Every simulated conversation says so on screen.
• The replies are automatically generated and fictitious. They may be inaccurate, inconsistent or surprising, and reflect neither the real thoughts, intentions nor words of the person imitated.
• They must not be the basis for any important decision (personal, romantic, professional, medical, legal or financial).
• The Service is not a psychological support tool. If you are going through a difficult time (bereavement, break-up, distress), a professional or a helpline can help you — in France, 3114 (national suicide prevention line, free, 24/7).

4. User account

• The Service is reserved for people aged 18 or over. By creating an account, you certify that you are an adult. The Publisher may close an account opened by a minor.
• Registration requires a valid email address, verified by a code or a link sent by email. Disposable or temporary addresses are refused.
• One account per person. Creating several accounts, in particular to benefit from the free offer several times, is prohibited.
• You are responsible for keeping your password confidential and for any use of your account. Notify the Publisher without delay of any unauthorised use: contact@4inte.fr.
• The information provided (first name, optional gender) is used only to personalise the simulations.

5. Free offer

Each new account, once per person, receives free of charge:

• the import of one contact, whose “standard profile” may be written by a lighter artificial intelligence, less accurate than the paid “premium portrait”;
• one simulated message (one generated reply).

Beyond that, importing additional contacts (“premium portrait”) and simulated replies are paid for with credits, according to the Terms of Sale. Adding messages to a contact already imported remains free. The Publisher may change the free offer for accounts created after the change.

6. Imported conversations and third-party rights

Conversations contain messages and information about other people (the “Contacts”). By importing a conversation, you guarantee that:

• you personally took part in that conversation and obtained it lawfully (export from your own accounts);
• you use it only for your personal use, within the Service;
• the person concerned has not objected to the use of their messages: you do not import the conversations of a person who has told you they refuse to be simulated;
• you only import what is useful for the simulation, and avoid leaving unrelated information in it (documents, bank details, information about other people);
• you will delete the contact without delay if the person concerned asks you to, directly or through the Publisher.

Minors. Simulating a minor is permitted in an ordinary family or friendly context (for example a brother, a sister, a nephew), under your responsibility: you guarantee a personal and well-meaning use. The minor concerned or their legal representatives may ask for the contact to be deleted at any time.

You remain the owner of your content. You grant the Publisher a non-exclusive, free licence, limited to the lifetime of your account, solely to store, process and send it to the artificial intelligence providers in order to provide you with the Service. The Publisher does not read, publish or use it for any other purpose, except where required by law or to handle an abuse report.

7. Prohibited uses

In particular, it is prohibited:

• to present a simulated reply as a real message from the person imitated, to share or publish it (social networks, messaging apps, screenshots), or to use it to deceive a third party;
• to use the Service to impersonate a person, harass, threaten or disparage them, or invade their privacy or harm their reputation (in particular article 226-4-1 of the French Criminal Code);
• to generate sexual or humiliating content involving a real person, or hateful, violent or unlawful content;
• to generate any sexual, romantic or seductive content involving a minor: the account is then closed immediately, without refund of credits, and the facts may be reported to the authorities (PHAROS platform);
• to simulate a deceased person;
• to get around the limits of the Service (multiple accounts, disposable addresses, automation, mass extraction), disrupt its operation or test its security without permission;
• to resell the Service or make it available to third parties.

The artificial intelligence providers may refuse certain requests that breach their own usage policies.

8. Suspension and closure of the account

• You can delete your account at any time from ⚙ Settings → “Delete my account”. All your data is then erased; any remaining credits are lost.
• In case of breach of the Terms of Use, the Publisher may suspend or close the account, after a warning by email except in an emergency or serious breach (impersonation, harassment, unlawful content, fraud). Remaining credits are lost if the account is closed for serious breach or fraud; in other cases, they are refunded.
• Accounts whose address was never confirmed are deleted after 7 days. Accounts inactive for 3 years and without credits are deleted, after a warning email sent one month beforehand.

9. Availability and liability

The Publisher strives to ensure access to the Service, without any guarantee of continuous availability: maintenance, updates, outages, or unavailability of the AI or payment providers may interrupt it. The Service depends on third-party AI models whose behaviour may change.

To the extent permitted by law, the Publisher is not responsible for the content of the generated replies, the use you make of them, or the consequences of any use contrary to the Terms of Use. Nothing in the Terms of Use limits the rights the law grants you as a consumer, or the Publisher's liability in the event of gross negligence or personal injury.

You can download your data at any time (⚙ Settings → backup); it is up to you to keep a copy if it matters to you.

10. Changes to the Terms of Use

The Publisher may change the Terms of Use. The new version is published on this page; it is shown to you the next time you log in and must be accepted to keep using the Service. If you refuse it, you can delete your account.

11. Applicable law, mediation and disputes

These Terms of Use are governed by French law. If there is a problem, first contact the Publisher: contact@4inte.fr. You can also bring the matter before the competent court under the rules of general law.
